We strive to display product descriptions, colours, images, and details as accurately as possible. However, actual colours and product appearance may vary depending on your device settings and display configurations.

We do not guarantee that products will appear exactly as displayed on your device.

All product descriptions, pricing, availability, and specifications are subject to change without notice.

Product availability is subject to stock availability and SHELF MADE reserves the right to discontinue or amend products at any time.

SECTION 3 - ORDERS

Placing an order constitutes an offer to purchase products from SHELF MADE.

Orders are only accepted once payment has been successfully received and SHELF MADE confirms acceptance of the order.

SHELF MADE reserves the right to refuse, cancel, or limit any order where:

products are unavailable;
pricing or product information contains obvious errors;
fraudulent or suspicious activity is suspected;
payment cannot be verified;
abuse of promotions or policies is identified; or
required by law.

If an order is cancelled after payment has been received, the customer will be refunded in accordance with applicable South African law.

Products displayed on the website are subject to availability and may occasionally become unavailable after an order is placed due to inventory discrepancies, supplier issues, or simultaneous purchases.

You warrant that purchases are for personal use only and not for commercial resale, distribution, or export unless otherwise agreed in writing.

All purchases remain subject to our Return & Refund Policy.

SECTION 4 - PRICES AND BILLING

All prices displayed on the website are in South African Rand (ZAR) and include VAT where applicable, unless otherwise stated.

Prices, promotions, and discounts may change without notice.

You agree to provide current, accurate, and complete payment and account information for all purchases.

SHELF MADE reserves the right to refuse or cancel orders where payment cannot be authorised or verified.

In the event of an obvious pricing error, SHELF MADE reserves the right to cancel affected orders and issue a full refund.

SECTION 5 - SHIPPING AND DELIVERY

Delivery times are estimates only and are not guaranteed.

SHELF MADE shall not be liable for delays caused by courier services, supplier delays, customs processes, load shedding, strikes, civil unrest, weather events, or circumstances beyond our reasonable control.

Risk in products passes to the customer upon delivery to the delivery address provided in the order.

Customers are responsible for ensuring delivery information is accurate and complete.

SECTION 6 - INTELLECTUAL PROPERTY

All content available through the Services, including trademarks, logos, branding, graphics, photographs, product descriptions, text, designs, videos, and website content, are owned by or licensed to SHELF MADE and are protected under South African and international intellectual property laws.

SHELF MADE is powered by Shopify, which enables us to provide our online store and Services.

All purchases and transactions made through this website are concluded directly between you and SHELF MADE.

To the fullest extent permitted by law, Shopify shall not be liable for any claims, damages, losses, or disputes arising from purchases made through SHELF MADE.

SHELF MADE may suspend or terminate access to the Services at any time where a user breaches these Terms or engages in unlawful, fraudulent, or harmful conduct.

Termination shall not affect any rights or obligations accrued prior to termination.

SECTION 16 - DISCLAIMER OF WARRANTIES

Except where otherwise required under applicable South African law, SHELF MADE makes no warranties or representations beyond those expressly stated in these Terms.

The Services and products are provided on an “as available” basis.

Nothing in these Terms excludes or limits any statutory rights, warranties, or protections that cannot legally be excluded under the CPA or other applicable laws.

SECTION 17 - LIMITATION OF LIABILITY

To the fullest extent permitted under applicable South African law, SHELF MADE shall not be liable for any indirect, incidental, consequential, or special damages arising from the use of the Services or products purchased through the Services.

SHELF MADE’s total liability for any claim shall not exceed the amount paid by the customer for the relevant product or service giving rise to the claim.

Nothing in these Terms excludes liability where such liability cannot legally be excluded, including liability arising from fraud, gross negligence, or rights granted under the CPA.

SECTION 18 - INDEMNIFICATION

You agree to indemnify and hold harmless SHELF MADE, its owners, employees, affiliates, contractors, and service providers from claims, liabilities, damages, losses, and reasonable legal costs arising from:

your breach of these Terms;
your unlawful conduct; or
your misuse of the Services.

SECTION 19 - FORCE MAJEURE

SHELF MADE shall not be liable for delays or failures caused by events beyond our reasonable control, including but not limited to load shedding, internet outages, supplier failures, courier disruptions, strikes, riots, natural disasters, pandemics, cyberattacks, governmental actions, or civil unrest.

Our obligations shall be suspended for the duration of such events.

SECTION 20 - ELECTRONIC COMMUNICATIONS

By using the Services, you consent to receiving communications electronically, including invoices, notices, order confirmations, disclosures, and updates in accordance with ECTA.

SECTION 21 - SEVERABILITY

If any provision of these Terms is found unlawful or unenforceable, the remaining provisions shall remain valid and enforceable.

SECTION 22 - WAIVER; ENTIRE AGREEMENT

Failure by SHELF MADE to enforce any provision of these Terms shall not constitute a waiver of such rights.

These Terms, together with our policies, constitute the entire agreement between you and SHELF MADE regarding use of the Services.

SECTION 23 - ASSIGNMENT

You may not assign or transfer your rights under these Terms without prior written consent from SHELF MADE.

SHELF MADE may assign or transfer its rights and obligations without restriction.

SECTION 24 - GOVERNING LAW

These Terms shall be governed by and interpreted in accordance with the laws of the Republic of South Africa.

Any disputes arising from these Terms or use of the Services shall be subject to the jurisdiction of the South African courts.

SECTION 25 - CHANGES TO TERMS

SHELF MADE reserves the right to update or amend these Terms at any time by publishing revised Terms on the website.

Material changes will not apply retrospectively to orders already placed.

Continued use of the Services after amendments constitutes acceptance of the revised Terms.
